GENERAL DATA PROTECTION REGULATION (GDPR) COMPLIANCE

As part of our ongoing commitment to providing an honest service to all the families in our care, we have taken the time to research and piece together a detailed Privacy Policy to ensure we are GDPR compliant.

GDPR = General Data Protection Regulation

We know how important it is to be clear about the information that we will gather from you, what it will be used for and finally, what will happen to the data once the funeral is completed.

We hope that this policy answers many of the questions relating to your data. Still, if you are unsure of anything, you can contact the appointed Data Privacy Manager, who will be happy to clarify any points or deal with any concerns.

It is essential that you freely consent and specify what data you permit us to share with third parties, so before we pass your information on to anyone involved in the arrangements, we will ask for you to discuss with us any sharing of data

The consent is completely separate from any other section regarding the acceptance of services/fees and acceptance of Ts&Cs - it is purely for the information that will be shared.

We want to reassure you that we do not and will not use or sell your data for marketing, cold-calling, or for our own monetary gain.

Type of data collected

The type of data we require to obtain from you includes, but is not limited to:

  • Full name

  • Relation to the deceased

  • Address

  • Contact telephone number(s)

  • Email address(es)

  • Signature

How your data is collected

There are various ways in which we collect your personal data, including, but not limited to:

  • Face-to-face - If you leave details during a quotation or when the relevant instruction and application forms are completed and signed to finalise the arrangements.

  • When you complete and submit our website's contact form

  • Via direct email enquiry (this is separate from our online contact form)

  • Over the telephone

    Technical data, including your IP address, specific browser settings, how you use this website, etc., may be automatically captured by cookies.  This online data is used for analytics regarding trends and volume of traffic to our website - we cannot access any personal or identifying details from cookies.

However, you can change your browser settings to refuse all or some cookies.  Refusing cookies may make this webpage behave differently to the way it normally would.

How your data is used

For us to provide a comprehensive range of services, we will be required to use the information you provide to:

  • Follow-up any enquiry received that cannot be dealt with immediately, form the basis of a no-obligation quotation.

  • Apply for a burial or a cremation to take place

  • Assist medical professionals with the completion of certificates

  • Help the HM Coroner with any enquiries

  • Facilitate a meeting with a religious minister or celebrant to finalise the content of the service

  • Set up an online donations page

  • Collate and administer any charitable donations received in memory

  • Fully carry out requests made regarding floral tributes, funeral stationery, newspaper announcements, etc

  • Issue you with a full and final invoice and confirmation of all the arrangements discussed

  • Employ our embalmer to carry out hygienic treatment (if required/requested)

  • Contact a venue/catering service on your behalf

  • Deal with any complaint addressed to the business owner: Mr R D Elkin, Cert. FD c/o the head office address shown above.

  • To refer the file, including all stored data, to an external debt collection agency should the account become overdue for payment.

All individuals involved with assisting in the funeral services must have their own privacy policy in place.  Do not hesitate to request to see a copy of their policy if you are unsure.

The systems we have in use to store, receive and transfer your personal data may be accessed by the systems providers, who may be host outside of the European Economic Area (EEA)  

If this is the case, those systems providers/hosts are required to secure your data per UK Law.

CCTV Recording
We record moving images (CCTV Recording) at our premises (5 The Common, Parbold and 137-139 Manchester Road, Southport) to prevent crime, protect our premises and members of staff. 

This data is stored for a period of no more than 30 days.

Data security

All personal data obtained by Massam and Marshall Funeral Services Ltd is stored securely; only the Data Privacy Manager has full access to the data.

We have safeguards to help prevent data from being lost; there be any unauthorised access, alteration or disclosure.  
We will continue to monitor and, where necessary, review or amend the security measures in place.

Data retention

Full details of your personal data will be stored for as long as is appropriate for us to complete the services requested, including use for legal, accounting or administrative purposes.

By law, we are required to keep a record of basic information, including; name and contact details (address, telephone number, email) for a period of six years for HM Revenue and Tax purposes.

Your rights

In some circumstances, under data protection laws, you have a right to:

  • Request access to the data that we have obtained, how it is being used/stored

  • Ask for amendments to be made to the data you have previously provided

  • Apply for all personal data held to be deleted/destroyed

You may also be able to:

  • Object to your personal data being processed

  • Restrict the data that is being processed

  • Fully withdraw all previous consent

We do not charge any fee for reviewing your request or providing you with the personal data we hold.  However, be advised that the provision of this data is the sole responsibility of the Data Privacy Manager.

He will endeavour to process data requests within four weeks of receiving the initial application.  He will clarify an estimated timescale for a decision upon confirmation of receipt of your application.  

You will likely be asked for confirmation of identity.  This has been put in place to help ensure that the data we obtain is not disclosed to anyone except the person whose information we hold.
